General terms of delivery and payment
These general terms and conditions of delivery and payment (which are part of General terms of megkonovska.com) regulate the relationship between Margarita Konovska and the persons using the website and the online store at megkonovska.com
Art. 1. Goods are received only by signing of a document certifying the delivery and acceptance of goods. Delivery times of goods ordered through the online store are as follows:
- For the territory of Bulgaria – The delivery is carried out through the courier company Econt. For items ordered by 2:30 p.m. Bulgarian time – next day delivery after order confirmation. For goods ordered after 2:30 p.m. Bulgarian time – 2 working days after order confirmation.
- For the territory of the European Union – tracked and signed international postage. Tracking number is provided upon shipment (up to 2 working days after order confirmation). Shipping times usually take 7-14 working days.
- For the rest of the countries in the world – tracked and signed international postage. Tracking number is provided upon shipment (up to 2 working days after order confirmation). Shipping times usually take 10 -14 working days.
- Shipping cost depends on the rates of the courier company.
- Free delivery for the territory of Bulgaria for orders over €30.00.
- Free worldwide delivery for orders over €100.00.
IMPORTANT! The indicated delivery times shall apply as long as they do not contradict delivery times enforced by the relevant courier company.
Art. 2. The website can be viewed freely without registration. Registration is required only when using certain features of the website and is absolutely voluntary and free. To register, you need to fill a registration form. Only one account can be registered with one email address.
megkonovska.com is an e-commerce platform through which users can conclude contracts for the purchase and sale and delivery of the products offered by the Provider on the platform, including the following:
- To register and create a profile for viewing the Provider’s electronic store and using the additional services for providing information;
- View products, their features, prices and delivery conditions;
- To enter into contracts with the Supplier for the purchase and sale and delivery of the products offered on the megkonovska.com platform;
- To make any payments in connection with the concluded contracts, incl. through electronic means of payment.
- To receive information about new products offered by the Provider on the megkonovska.com platform;
- To make electronic statements in connection with the conclusion or execution of contracts with the Supplier on the megkonovska.com platform through the interface of the megkonovska.com page available on the Internet;
- To be notified of the rights arising from the law, primarily through the interface of the megkonovska.com platform on the Internet;
- To exercise their right to opt out, where applicable, under the Consumer Protection Act.
IMPORTANT! By creating an account, you declare that you are at least 18 years old.
If you do not wish to register an account, you have the option of shopping as a guest, and the data provided in this case are processed only for the purposes of executing the specific order and are not stored for your subsequent orders.
Art. 3. Only those goods which the system allows to be added to the shopping cart may be purchased through the online store. All pictures shown are for illustration purpose only. Actual product may vary due to product enhancement.
Art. 4. All prices shown on the website/online store are in Bulgarian leva and are valid only at the time of their publication. Margarita Konovska reserves the right to change them without notice at any time. The prices of online purchases, confirmed by Margarita Konovska are final and shall not be changed. The prices on the website/online store are final and include all taxes and fees, except the price for processing and delivery, indicated separately, when such is due. The decorations are not included in the price.
Art. 5. Only users who have accepted the general terms and conditions can place orders. To place an order, it is necessary to fill in the order form.
Art. 6. The price due for goods ordered through the online store can be paid by one of the following methods: cash on delivery, bank card payment, bank transfer. Please, consider that in certain cases some of the payment methods can be unavailable for certain orders. All payments are made in Euro. By accepting these terms and conditions the buyer agrees expressly and unconditionally, in all cases, except for the “cash on delivery” payment, including but not limited, to pay to Margarita Konovska, in advance and in full amount, the purchase price of any item ordered through the online store. If paying via “cash on delivery” the buyer hands over to the courier the total amount (including the purchase price and price for processing and delivery) specified in the invoice/receipt and authorize the courier to hand it over to Margarita Konovska on his/her own behalf and account; the payment is specified in the document, verifying the delivery of the item, serving as a proof of receipt.
IMPORTANT! For payment via bank card/bank transfer, you may be charged with bank fees/commissions determined unilaterally by the respective bank/finance institution.
IMPORTANT! As per art. 113, para. 4 of the Value Added Tax Act invoices and corrections of invoices are issued within 5 (five) calendar days after the date of purchase. After that, Margarita Konovska will not issue invoices or corrections of previously issued invoices.
Art. 7. The distance sale contract between Margarita Konovska and the buyer shall be deemed concluded at the time of confirmation of the specific order by Margarita Konovska. Confirmation of a distance sale contract, including of the information under Art. 47, para 1 of the CPA shall be done via the email provided by the buyer.
Art. 8. Margarita Konovska reserves its right unilaterally, without informing the buyer, to extend all delivery times by up to 14 days. Goods are delivered against signature, to the entrance of the building. If personal delivery to the recipient is impossible or difficult, the shipments shall be delivered as follows:
for business address – to a person, whose place of work is at the address, by indicating the name and position/department of the person receiving the shipment.
for home address – to a member of the household, by indicating the name of the person who received the shipment and their relationship with the recipient.
In case the order cannot be delivered on first visit, through no fault of Margarita Konovska/the courier (in case no one is present at the address, etc.), the person making the delivery leaves a notice stating the telephone number to which the recipient should call within three working days to fix a new deadline for delivery. In case the order cannot be delivered on the second visit, through no fault of Margarita Konovska/the courier, the distance sale contract is automatically terminated, in which case, as a sanction for the buyer’s fault, Margarita Konovska shall retain all sums paid by the buyer. The provision referred to in the previous sentence also applies in cases where the recipient unreasonably refuses to accept the shipment. Margarita Konovska/the courier is not responsible for failure to deliver when the buyer has provided false, incomplete and/or inaccurate personal data, including when the address given is incomplete, inaccurate or fictitious.
IMPORTANT! Margarita Konovska shall not be liable for any item which was not claimed or picked up during the eligible period. After this period Margarita Konovska has the right to charge a fee for storage of each item at the amount of five Bulgarian leva per day.
Art. 9. Upon receipt of the product the buyer is obliged to review it and if he/she finds evident shortcomings, missing accompanying accessories and/or missing documents required by the Bulgarian legislation, he/she shall immediately inform the person making the delivery. Failure in doing so, the product is deemed approved and the buyer loses the right to claim that it was delivered with evident shortcomings, missing accompanying accessories and/or missing documents required by the Bulgarian legislation, at a later date. Returns of purchased through the online store goods are carried under the provisions of the APDCDSSG and Consumer Protection Act (only for consumers) and/or in accordance with the terms and conditions of their commercial warranty. Art. 10. Pursuant to art. 50 of the CPA, a consumer is entitled to withdraw from the distance contract without stating a reason, without compensation or penalty and without covering any costs, save for the costs provided for in art. 54, par. 3 and art. 55 of the CPA, within 14 days as from the date of: acceptance of the goods by the consumer or a third party other than the carrier and indicated by the consumer, or when the consumer has ordered in one order many items that are delivered separately – from the date on which the consumer or a third party other than the carrier and indicated by the consumer has accepted the last item.
The right to withdrawal may be only exercised if the consumer has presented to Margarita Konovska: the goods in its original package in perfect condition, all pertaining to the goods accessories, belongings and documents, as well as the original purchase documents (cash receipt/invoice).
In case the right to withdraw from a distance contract has been exercised, the consumer shall send or deliver the goods back to Margarita Konovska no later than 14 days from the day on which the consumer informed Margarita Konovska of his/her decision to withdraw from the contract. The risk of accidental loss or damage is born by the consumer until the goods are delivered back to Margarita Konovska.
Art. 11. Protection of personal data – By accepting these terms and conditions, the user gives his/her express indefinite and unconditional consent, until its explicit written cancellation, his/her personal data to be collected, stored, processed and used by Margarita Konovska and/or by third parties authorized by the company, including but not limited to: courier services companies, banks and others, for the purpose of execution of the distance sale contract and delivery of ordered goods.
The user is obliged to protect the confidentiality of the user name and password provided to him/her by Margarita Konovska. Every order made through the online store shall be considered regular by Margarita Konovska, if when placing such an order a user name and password accepted by the system as valid were used, regardless of whether they were used by a person other than the holder or by unauthorized person.
